Applications for Divorce are dealt with in the Circuit and the High Court.   In order to apply to the Court for a Decree of Divorce the spouses must have lived apart from one other for a period or periods of time amounting to at least four of the previous five years and there must be no reasonable prospect of reconciliation between the spouses.  In granting the Decree of Divorce the Court will make such provision as it considers necessary having regard to the circumstances that already exist between the spouses.

Many Divorce Decrees are granted by the Court on the basis of an existing Separation Agreement of a Decree of Judicial Separation.

The granting of a Decree of Divorce allows parties to re-marry if they so wish.
