It was reported in the media on Friday 20th July, 2012 that patient groups recently met with the Oireachtas Health Committee with regard to the DePuy Hip Implant Recall of August, 2010.   Patient representatives told the Committee that many patients are having difficulty in accessing their medical files due to long delays in getting their documentation copied and sent to them.

Two hip implant devices namely the DePuy ASR™ XL Acetabular System and the DePuy ASR™ Hip Resurfacing System were the subject of a worldwide recall in August, 2010  following higher than expected failure rates recorded in England and Wales and Australia.  The recall was prompted by the alarming number of complaints from patients who had received these devices.

To date, DePuy has not paid any compensation nor has it agreed to do so in respect of patients’ pain and suffering.   As a result, patients affected by the DePuy hip implant recall have no option but to instruct a solicitor to commence proceedings on their behalf.

If you, or someone you know, has been affected by the DePuy Hip Implant recall you should seek immediate legal advice as there are strict legal time limits within which you will be allowed to bring a claim in respect of this issue.  The applicable time limit  must be assessed on a case by case basis but it is essential that legal advice be sought sooner rather than later as it will be two years in August since the worldwide recall was announced.   This is significant as the limitation period applicable to personal injury cases is two years.   We are experienced in handling cases of this nature and we act for a number of people who received a defective DePuy hip implant.
